Recent Changes to Legislation

Valuers Registration in NSW


On 1 March 2016, the NSW Valuers Act 2003 was repealed.

Since that date, there is no such term as a Registered Valuer in NSW. The term 'Qualified Valuer' is used in the new strata legislation (as well as the Land Acquisition (Just terms Compensation) Act 1991) and refers to an Associate, Fellow or Life Fellow of the Australian Property Institute and excludes a Student or Provisional member. (A member of the Australian Valuers Institute must be a Fellow or Life Fellow and excludes an Associate or Student member of that Institute; and a member of the Royal Institution of Chartered Surveyors must be a Chartered Valuer member). That is, only the above prescribed members of the above bodies can carry out unit entitlement valuations.

Wal Dobrow is a Fellow of the Australian Property Institute and is a Qualified Valuer that can carry out Valuations for Unit Entitlements, and provide Valuer's Certificates for the registration of Strata and Community Title Plans.

New Strata Legislation in NSW


On 30 November 2016, the following Strata legislation was enacted.

  • The Strata Schemes Development Act 2015.
  • The Strata Schemes Development Regulation 2016.
  • The Strata Schemes Management Act 2015.
  • The Strata Schemes Management Regulation 2016.

The Strata Reform legislation created significant changes dealing with Unit Entitlements. These changes prohibited developers and their consultants from writing their own unit entitlements, and which now requires a 'Qualified Valuer' to carry out the determination of Unit Entitlements based upon Market Value as defined by the Strata Schemes Development Act 2015.

The new legislation allows a certain class of person to object to and have the Unit Entitlements reallocated if the Unit entitlements are proven to be unreasonable and the Tribunal exercises its discretion to allow the change to the Schedule of Unit Entitlements set out in the Strata Plan.

New Strata Plans

We provide Valuer's Certificates with a Schedule of Unit Entitlements, and a Statement of Reasoning as required by our professional standards, and the Strata Schemes Development Act 2015.

Strata Plans of Subdivision

The type of Valuer's Certificate and the Schedule of Unit Entitlements depends upon whether Common Property or a Development Lot is affected. We provide the full range of Valuer's Certificates in compliance with the Land Registry Services requirements.

Reallocation of existing UE

We provide a cost effect two stage solution. Firstly, we determine whether the existing Unit Entitlements are unreasonable and recommend if they should be changed (Stage 1). Then, if the Client wishes to proceed we will prepare an Expert Witness Report in accordance with the Tribunal's Code of Conduct (Stage 2).

About us

We have been Registered Valuers since 1984 and specialise in Strata and Community Title.

Wal Dobrow is the Managing Director of Unit Entitlement Valuations Pty Limited and has been a Registered Valuer without limitation since 1984. He has specialised in strata and community title valuations, and has carried out the unit entitlement assessments of the largest community and strata schemes in NSW. He serves on the Strata Industry Working Group and wrote the Common Property Memorandum that solves the majority of issues relating to the repair or maintenance responsibility between Lot Owners and the Owners Corporation, and which has now been adopted into the new strata legislation in NSW. He also serves on the Australian Property Institute's Professional Standards Sub Committee on Strata which has recently issued the Guidance Notes and Member's Advice for Unit Entitlements in NSW.

Paul Sarkany is a Director of Unit Entitlement Valuations Pty Limited and has been carrying out valuation research and analysis since 2016. He has been on the Dean's Merit List at the Western Sydney University for 2015 and 2016 where he has been studying for a Bachelor in Business - Major in Property, and a specialisation in Finance.
